Calcutta HC Again Rejects Abhishek Banerjee’s Plea For Urgent Hearing On Foreign Travel Request

The Calcutta High Court on Monday again rejected Trinamool Congress (TMC) general secretary and Lok Sabha member Abhishek Banerjee’s petition for an urgent hearing in his case, in which he sought permission to travel overseas for ophthalmic treatment.

A single-judge bench of Justice Saugata Bhattacharya dismissed Banerjee’s fresh request for a ‘fresh hearing’, saying the matter would be heard in the court’s regular cause list.

Banerjee had filed a writ petition with the high court on June 23, seeking permission to travel abroad for 7 days to treat an eye ailment. Along with the petition, he had requested an urgent hearing.

On June 24, Justice Bhattacharya, however, denied the petition’s request to fast-track it, noting there was no reason to give priority to this appeal and it would be heard on the normal course.

On Monday, Banerjee’s lawyer again sought an urgent hearing before the same bench, which again stood its ground and refused to change the timeline.

The TMC chief, who is facing a probe by the Criminal Investigation Department (CID) for signature forgery, is currently not permitted to travel outside India without the court’s permission.

In this case, the signatures of some TMC MLAs were found affixed to a resolution pertaining to the selection of Opposition representatives in the West Bengal Assembly. The CID had conducted two interrogations of Banerjee pursuant to a court order.

In granting him interim protection from coercive action, including arrest, Justice Kaushik Chanda had directed Banerjee not to leave the country without prior permission from the court.

This limitation was the reason Banerjee came before Justice Bhattacharya’s bench, seeking permission to go abroad for medical treatment and urging that the plea be heard on an urgent basis.

Meanwhile, Banerjee has been receiving treatment for an eye injury he received in a road accident in October 2016 as he returned to Kolkata from a party programme in Murshidabad. He had undergone initial treatment in hospitals in India, and then later, specialised treatment was provided to him overseas.
