Telangana High Court deferes verdict on Danam Nagender disqualification plea to Friday
The has once again adjourned the verdict regarding the disqualification of Khairatabad MLA Danam Nagender. The Court had previously reserved its judgment on February 21 concerning two petitions challenging the Speaker’s decision on Nagender’s disqualification. Although the verdict was scheduled to be delivered today, the High Court announced on Wednesday that it would be pronounced on Friday (September 18).

It is well known that BRS has been demanding the disqualification of , who joined the Congress party after winning the election on a BRS ticket. In addition to lodging a complaint with the Speaker, the party also approached the courts. Consequently, the Supreme Court directed the Telangana Assembly Speaker to make a decision on the issue. Upon inquiry, the Speaker ruled that Danam Nagender had not legally defected from the party, stating there was insufficient evidence to disqualify the Khairatabad MLA under the Anti-Defection Law.
However, BJP Legislature Party Leader Maheshwar Reddy and BRS MLA Padi Kaushik Reddy filed petitions in the Telangana High Court challenging the decision made by Speaker Gaddam Prasad Kumar. The petitioners pointed out that while Danam Nagender won the Telangana Assembly election representing BRS, he subsequently contested an election on a Congress ticket six months later. The petitioners argued that by campaigning for the Congress party, Nagender had voluntarily relinquished his BRS membership, and urged the court to take his conduct into account.
On the other hand, the counsel representing him argued that the petitioners relied primarily on newspaper reports and photographs showing him meeting Congress leaders or wearing a Congress scarf. He contended that such evidence could not prove he had voluntarily given up his BRS membership, noting that his name remains recorded as a BRS member in the Assembly records.
Meanwhile, Tulasi Raj Gokul, Standing Counsel for the State Legislative Assembly, presented arguments on behalf of the Assembly Speaker. After considering all these aspects, the High Court bench reserved its verdict on the 21st of last month. Although the High Court was scheduled to deliver the final verdict today, it has adjourned the matter to Friday.
